The primary objective of this post is to highlight the importance and gravity of the existing tax evasion in Latin America and the Caribbean today. A study conducted by Santiago Diaz de Sarralde Miguez reports that Latin America and the Caribbean are characterized by a relatively low tax burden, which averages 22.8% of GDP. That is 11.5% less than the OECD (2015). While it is true that there are large differences between countries, as the tax burden varies from 12.4% in Guatemala to 38.6% in Cuba.
Technological progress and trade liberalization dramatically increased electronic trade and opened new chapter for the businesses to remotely supply services and intangibles to the customers anywhere around the world. Such rise of e-trade and emergence of global economy created new challenges for the policy makers in applying goods and services tax (GST) on cross-border business to consumer (“B2C”) transactions.
With regards to the granting of taxing rights, in line with the destination principle Chilean VAT generally levies services provided or utilized in Chile. The destination principle is designed to ensure that tax on cross-border supplies is ultimately levied only in the jurisdiction where the final consumption occurs, thereby maintaining neutrality within the VAT system as it applies to international trade.
In this short commentary I briefly raise three critical points against the assumptions at the basis of this report. I discuss the temporality of employment in GVCs; the gendered construction of skills and employment disadvantage; and the need to move the debate from individual wages to social wages in order to truly assess the ‘reproductive’ - or more simply, livelihood - implications of GVCs employment on labouring classes.
The COVID-19 pandemic has exposed the weaknesses of the current patterns of production and consumption, exemplified by GVCs and the global trade and investment order in which they operate. These fragilities have resulted in the aforementioned social, economic and financial crises but what they represent most of all, is a crisis of responsibility in which powerful actors, state and private, that have been the main beneficiaries of GVCs, have failed to discharge their ethical and normative obligations to those most vulnerable within their production and supply chains. To this end, a new approach is sorely needed to address the vulnerabilities of a global economy built on fragile GVC governance that serves as new nodes of global inequality and precarity.
WTO members should revisit the liberalization commitments with a view to engaging in further impact assessments of present and proposed liberalization commitments. More importantly, international and national trade policy makers should welcome new imaginaries of a global digital economy, including the use of trade policy tools to make domestic digital economies competitive at the global stage. This requires a re-conceptualization of the foundations of international trade law, and national tax, competition, property, privacy and data protection laws.
This paper engages in a critical legal analysis of Professor Ian Taylor’s article, Sixty Years Later: Africa’s Stalled Decolonization. It is not meant to be an exhaustive analysis but will provide a limited legal perspective of the article’s foundational arguments on the underlying causes of Africa’s economic underdevelopment, through a legal lens rooted in intellectual property (IP) law and international investment law (IIL).
Legal education has begun in Myanmar since 1878 under the administration of British Colonial Government. Rangoon (Yangon) College was founded as an affiliation of Calcutta University (CU), India in 1884-1885. British Government passed the University of Rangoon Act in 1920 through which the University of Rangoon was founded and has come into existence.
In fulfilling this 'global' role, I highlight a growing propensity of sub-national governments to challenge the status quo. More importantly, I argue that as the intermestic nature of trade and investment norms are becoming more evident, the COVID-19 Pandemic offers us an opportunity to reflect on the changing role of sub-national governments as activists and sites of resistance against inequalities in international trade and investment rules.
International trade is not free of costs; the dominant view is that the benefits outweigh these costs. Following Ricardo and other free trade enthusiasts, the premise inbuilt in international economic law is that trade is a win-win social activity. Everybody would be better off in the long-run. Meanwhile, the immediate losers could perhaps expect that international economic rules would take their interests seriously, as in making their vulnerability visible or ensuring they receive compensation, particularly when the long-run takes too long to arrive.
