When, in 1963, Kwame Nkrumah emphasised that Africans need to unite, he was vigorously reinforcing the pertinence of motioning the continent on the ideation of pan-Africanism, unity, and continental solidarity. There were evident implications of his rhetoric. The first is that the arbitrary borders of the continent could not continue to subsist. In his invocations, he insisted on the fact that it was pertinent to render 'existing boundaries obsolete and superfluous.' At the time this viewpoint was articulated, it met with wide agreement. Although certain leaders were persuaded that it was important to do away with the borders, others who had just gained independence from colonial powers emerged as nationalists and were determined to consolidate their victories at a national level, given that their people had fought hard to win independence from imperialism and colonial structures.

Kenya should consider the impact of strict data localization measures on digital trade. Kenya should also sign and ratify the Malabo convention before requiring other countries to do so as a means of meeting the adequacy requirement its data protection regulations proposes. This action will signify Kenya’s commitment to intra-African partnership and will enhance cooperation in the continent. In addition, Kenya should consider concluding reciprocal (bilateral) data protection agreements with specific countries to promote trade as it settles its broader international and regional treaty framework position.

Nalule’s book is a comprehensive critical analysis of the energy access and energy poverty issues that plague Sub-Saharan Africa (“SSA”). She conducts this discourse within the energy transition discussion and presents it through the lens of the sustainable development theory.
To ensure that innovative capacity is developed on the continent, it is pertinent to promote regional innovation. As a starting point, negotiators of the AfCFTA may consider including in the text appropriate provisions that will allow the collaboration and nurturing of innovative capacity in Africa. Open innovation is an approach that meets the needs of Africa and is worth considering.
In the webinar, the panelists brilliantly discussed salient subjects pertinent to global intellectual property (IP) rights rules and relevant implementation mechanisms at regional and national levels. In quintessential Afronomicslaw.org fashion, the discussions underscored Global South interests and reinforced the importance of fostering development-oriented IP systems.
This article will briefly examine this dynamic across three interconnected dimensions: (1) flexibility and innovation in IEL agreement models, with a focus on trade agreements, that better integrate economic and social development goals and allow parties to adapt to new circumstances or phase in commitments on a more incremental basis; (2) flexibility in implementation of trade disciplines and agreements; and (3) legal and regulatory innovation that can both define and flow from IEL agreements. These three dimensions take into account both treaties themselves and how they relate to changes in law and regulation in practice, drawing a link between international agreements and their operation that is particularly important in times of change or uncertainty.
